0. Definition of Terms
For the purposes of these Terms:
"Stream" or "Broadcast" refers to any live video content transmitted via the StreamrTV application and distributed through the decentralized Streamr Network infrastructure.
"User", "you", or "your" refers to any individual or entity that accesses or uses the Service.
"Service" refers to the StreamrTV application and any associated tools, interfaces, or moderation mechanisms provided by Streamr Apps AG.
"Content" includes any audio, video, text, graphics, or other media shared via the Service.
"Decentralized Network" refers to the Streamr Network, which facilitates peer-to-peer data transport and does not rely on centralized servers for data delivery or control.
"Super Balloons" refers to digital products that Viewers can purchase from Merchants through our integrated payment processing system to support content creators and causes.
"Merchant" refers to verified individuals or business entities that have completed our onboarding process and are authorized to sell Super Balloons through the Service.
"Broadcaster" refers to any individual or entity that creates and transmits live video content via the StreamrTV application. Broadcasters may set up their own Merchant accounts to sell Super Balloons for themselves, or may promote and facilitate sales of Super Balloons on behalf of third-party Merchants during their livestreams.
"Viewer" refers to any individual who watches live video content on StreamrTV and may purchase Super Balloons.
"Payment Processor" refers to Stripe, Inc. and its affiliates, which provide payment processing services for Super Balloons transactions.
1. Introduction
StreamrTV is a decentralized live broadcasting application powered by the Streamr Network (the "Service"), and is operated by Streamr Apps AG, a company domiciled in the Canton of Zug, Switzerland ("Streamr Apps", "StreamrTV" "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not accept these Terms, you may not use the Service.
StreamrTV is not responsible for and does not endorse any Content made available through the Services.
StreamrTV is an application that leverages the Streamr Network, a decentralized, permissionless protocol for real-time data transport. The Streamr Network is not owned, operated, or controlled by Streamr Apps AG. It is an open, public infrastructure composed of independent nodes that transmit data peer-to-peer. Streamr Apps AG is one of many ecosystem participants and does not control or govern the operation of the Decentralized Network.
StreamrTV offers Super Balloons that enable monetary support for Merchants. Broadcasters can set up Merchant accounts for themselves to sell Super Balloons. Alternatively, Broadcasters may promote the sale of Super Balloons from third-party Merchants during their livestreams to raise funds for those Merchants.
These services are provided in partnership with Stripe, Inc. ("Stripe") and are subject to additional terms and compliance requirements as outlined in these Terms.
2. Use of the Service
Functionality: StreamrTV allows users to broadcast and view live video content distributed via the decentralized Streamr Network using peer-to-peer infrastructure.
Access: The Service is accessible without account registration. However, certain advanced functionalities may require wallet connection or configuration, or another form of authentication or identification. The requirements for accessing the Service are subject to change without notice.
Jurisdictional Use: Availability of features may vary by jurisdiction, and you are solely responsible for compliance with applicable local laws.
2.1 Super Balloons
Functionality: Super Balloons are digital products that Viewers can purchase from Merchants through our payment processing partner, Stripe. Purchases support content creators and charitable causes.
Broadcasters may operate in two ways:
As Merchants: Broadcasters can create their own Merchant accounts to sell Super Balloons directly to Viewers, with funds going to the Broadcaster's account.
As Promoters: Broadcasters can promote and facilitate sales of Super Balloons on behalf of third-party Merchants (such as charities or other causes), with funds going directly to those third-party Merchants.
In both cases, all funds flow directly from Viewers to the designated Merchant through Stripe's payment processing.
Payment Processing: Payment processing services for Merchants on StreamrTV are provided by Stripe and are subject to the Stripe Connected Account Agreement and the Stripe Services Agreement. By selling Super Balloons as a Merchant or purchasing Super Balloons as a Viewer, you agree to be bound by these Stripe agreements, as they may be modified by Stripe from time to time.
Merchant Verification: All Merchants must complete a Know Your Business (KYB) or Know Your Customer (KYC) verification process through Stripe before selling Super Balloons. This includes identity verification, business registration confirmation (where applicable), and bank account validation.
Age Requirement: Merchants must be at least 18 years old (or the age of majority in their jurisdiction, whichever is higher) to sell Super Balloons and receive payouts. Minors are not eligible to create Merchant accounts or receive funds through Super Balloons.
Regional Restrictions: Super Balloons may not be available in all countries. Users in restricted jurisdictions (as determined by our payment processor or applicable law) will not have access to payment features. It is your responsibility to comply with all local laws regarding online payments and digital product sales in your jurisdiction.
Service Limitations: We reserve the right to restrict, suspend, or terminate Super Balloons functionality for any user at our sole discretion, particularly for compliance or risk management purposes.
2.2 Prohibited Business Activities for Super Balloons
Stripe Compliance Requirement: Merchants selling Super Balloons must comply with Stripe's Prohibited and Restricted Businesses List. This list is maintained and regularly updated by Stripe, and the current version is always available at:

Important Distinction: The restrictions in Stripe's Prohibited and Restricted Businesses List apply ONLY to users selling Super Balloons (Merchants). Users who broadcast or view content on StreamrTV without using Super Balloons are not subject to these Stripe-specific restrictions, though they must still comply with all other sections of these Terms, including our Content Guidelines in Section 5.
What the List Covers: Stripe's Prohibited and Restricted Businesses List includes:
Prohibited business categories that cannot use Stripe services (such as adult content, gambling, illegal products, weapons, marijuana-related businesses, certain financial services, and businesses in high-risk jurisdictions)
Restricted business categories that require additional verification and approval from both StreamrTV and Stripe before Super Balloons can be enabled (such as crowdfunding, cryptocurrency services, pharmaceuticals, and regulated industries)
Country-specific prohibitions that vary by jurisdiction
High-risk jurisdictions and persons where transactions are prohibited
Merchant Responsibility: It is the Merchant's sole responsibility to:
Review Stripe's complete Prohibited and Restricted Businesses List before selling Super Balloons
Ensure their business, products, or charitable purpose does not fall into prohibited categories
Obtain any required approvals for restricted business categories
Monitor Stripe's list for updates, as it changes periodically and the current version always governs
Enforcement: If we determine or are notified that a Merchant is selling Super Balloons for a prohibited or restricted business without proper approval, we will:
Immediately suspend the Merchant's ability to sell Super Balloons
Require additional verification or documentation for restricted categories
Permanently terminate Super Balloons access if the violation cannot be remedied
Note: This enforcement action affects only Super Balloons access, not general platform access for broadcasting or viewing content (subject to Section 5 Content Guidelines)
3. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service. By using StreamrTV, you warrant that you meet these requirements.
4. User Responsibilities
You agree and acknowledge that you are solely responsible for:
Possessing all rights necessary to stream or share content.
Complying with all applicable laws and third-party rights.
Refraining from broadcasting or facilitating illegal, infringing, or harmful content.
For Broadcasters promoting Super Balloons (whether as Merchants or on behalf of third-party Merchants), you additionally agree that you are solely responsible for:
Clearly disclosing to Viewers which Merchant will receive the funds from Super Balloons purchases
Accurately representing the third-party Merchant's identity and purpose when promoting sales on their behalf
Not misrepresenting your relationship with third-party Merchants
Ensuring that any third-party Merchant you promote has completed required verification processes
Complying with all applicable advertising and endorsement regulations
For Merchants selling Super Balloons, you additionally agree that you are solely responsible for:
Providing accurate business or personal information during the verification process
Maintaining valid registration and banking details
Complying with all applicable tax obligations related to Super Balloons sales
Reporting all Super Balloons income to relevant tax authorities and remitting all applicable taxes, including income tax, VAT/GST, or sales tax as required in your jurisdiction
Using received funds in accordance with your stated business purpose or charitable mission
Responding to any compliance requests from StreamrTV or Stripe
Ensuring your sale of Super Balloons complies with all applicable e-commerce and consumer protection laws
For Viewers purchasing Super Balloons, you agree that you are solely responsible for:
Ensuring you have authorization to use your selected payment method
Understanding that Super Balloons purchases are generally non-refundable once processed
Complying with your local laws regarding online payments and digital product purchases
5. Content Guidelines
StreamrTV may moderate content at the application level by restricting or de-listing:
Content that violates applicable laws.
Fraudulent, infringing, or deceptive materials.
Harassment, hate speech, or violent material.
Other content deemed harmful to the platform or its users.
Additionally, when using Super Balloons, the following are prohibited:
Using Super Balloons for personal peer-to-peer money transmission unrelated to legitimate business or charitable purposes
Fraudulent or misleading representation of the Merchant's identity or purpose
Selling Super Balloons for prohibited businesses as defined in Stripe's Prohibited and Restricted Businesses List
Any attempt to circumvent payment processing compliance or verification requirements
Misrepresenting the nature of Super Balloons or the purpose of funds raised
6. No Warranties
StreamrTV is provided “as is” and “as available.” Due to the decentralized nature of the network, we do not guarantee:
Uptime or uninterrupted availability.
Security or reliability of streams.
Moderation or enforcement outside of the StreamrTV interface.
7. Limitation of Liability
When using StreamrTV, the broadcaster is directly transmitting content to viewers in a peer-to-peer fashion, without the involvement of Streamr Apps AG or any other third parties in controlling, transmitting, or processing any content. The Service provided is limited to the StreamrTV user interface, which invokes media streaming and connectivity features already present in web browsers in a way that allows users to interconnect and share content peer-to-peer.
To the maximum extent permitted by law, Streamr Apps AG shall not be liable for:
Losses arising from use or inability to use the Service.
Unauthorized access to broadcasts.
Any damage, whether direct, indirect, incidental, consequential, or exemplary, resulting from third-party conduct or content, including but not limited to infringing or illegal broadcasts.
7.1 Super Balloons Limitations
Payment Processing Disclaimer: StreamrTV acts as a platform facilitating digital product sales between Viewers and Merchants. All payment processing is handled by Stripe under their terms of service. When a Broadcaster promotes Super Balloons on behalf of a third-party Merchant, funds go directly from the Viewer to that Merchant, not to the Broadcaster.
Platform Responsibilities: While Stripe handles payment processing, StreamrTV is responsible for:
Screening and approving Merchants before they can sell Super Balloons
Moderating content and enforcing our Content Guidelines (Section 5)
Mediating disputes between Viewers and Merchants (though we are not obligated to issue refunds)
Bearing financial responsibility to Stripe for chargebacks and payment disputes initiated by Viewers
Stripe's Role: Stripe is responsible solely for payment processing, KYB/KYC verification of Merchants, and compliance with financial regulations. Stripe is not responsible for content moderation, merchant screening decisions, or dispute resolution between users.
Force Majeure: We are not liable for Super Balloons service interruptions, delays, or failures caused by Stripe downtime, payment network failures, banking system disruptions, internet service provider failures, or other circumstances beyond our reasonable control. In such events, we will make reasonable efforts to restore service but assume no liability for lost transactions or inability to process payments.
StreamrTV is not responsible for:
Payment processing failures or delays
Disputes between Viewers and Merchants
Stripe's suspension or termination of payment services
Tax obligations arising from Super Balloons transactions
Compliance with financial or e-commerce regulations in your jurisdiction
The delivery, quality, or use of funds by Merchants
Refund Policy: Super Balloons purchases are final and non-refundable once processed. By purchasing Super Balloons, Viewers acknowledge and agree that:
Purchases are for digital products with no physical delivery
Funds are immediately transferred to Merchants
All sales are final at the point of purchase
Refund requests must be directed to the Merchant, who has sole discretion over whether to issue refunds
StreamrTV is not obligated to process or facilitate refunds
Chargebacks and Disputes: If a Viewer initiates a chargeback or payment dispute through their payment provider or bank, StreamrTV may be held responsible by Stripe for the disputed amount. By using Super Balloons, you acknowledge and agree that:
StreamrTV reserves the right to suspend or terminate accounts of users who initiate chargebacks
We may recover disputed amounts from the Merchant if fraud or misrepresentation by the Merchant occurred
We may pursue legal remedies to recover losses resulting from chargebacks
Excessive chargebacks may result in permanent platform ban
Chargebacks should only be used for unauthorized transactions; disputes about the nature or quality of Super Balloons should be directed to the Merchant first
Currency and Fees: Super Balloons are processed in currencies supported by Stripe. The following fees apply to each transaction:
Stripe payment processing fees (as determined by Stripe's pricing structure)
StreamrTV platform fee of 0-10% of the transaction amount
All fees are deducted from the purchase amount before funds are transferred to the Merchant. Viewers pay the displayed purchase price; Merchants receive the amount after all applicable fees are deducted. The specific platform fee percentage may vary and is determined at StreamrTV's discretion.
8. Privacy and Data Protection
StreamrTV respects your privacy and complies with the EU General Data Protection Regulation (GDPR).
We do not require registration or collect personal data for basic use. We do not track users across websites or share data with third parties.
We collect limited, pseudonymised analytics data through Matomo (self-hosted), including device type, browser version, country, page views, and referral source. IP addresses are anonymised and not stored in full.
StreamrTV uses only essential cookies for functionality and analytics, never for advertising or behavioural tracking. Users may opt out of analytics via website settings.
You have rights to access, correct, delete, or restrict your data. For any privacy queries, please refer to our privacy policy: https://stv.streamr.network/privacy, which explains how we treat your personal data and how we protect your privacy.
Payment Data: When you use Super Balloons, your payment information is processed by Stripe according to Stripe's Privacy Policy (https://stripe.com/privacy). StreamrTV does not store complete payment card information. We may share necessary transaction data with Stripe and Merchants for payment processing and compliance purposes.
Transaction Data Retention: Transaction records related to Super Balloons purchases are retained for 5 years to comply with financial regulations, tax requirements, and our legal obligations. After this period, transaction data may be anonymized or deleted unless longer retention is required by law.
9. Termination
We reserve the right to restrict access to the Service at our sole discretion, especially in cases of violation of these Terms or harm to the platform.
We may terminate or suspend your access to Super Balloons specifically (without affecting general platform access for broadcasting or viewing) if:
You fail to complete required payment verification processes
Your payment processing account is suspended or terminated by Stripe
You violate financial services compliance requirements
Your business falls into a prohibited category under Section 2.2 or Stripe's Prohibited and Restricted Businesses List
You fail to obtain required approvals for restricted business categories
Your use of Super Balloons presents unacceptable risk to StreamrTV or our partners
You engage in fraudulent activity or violate e-commerce regulations
Complete platform termination may occur for violations of other sections of these Terms, including but not limited to violations of Section 5 (Content Guidelines) or illegal content as addressed in Section 11 (Takedown Procedure).
10. Changes to Terms
We may revise these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
11. Takedown Procedure for Illegal Streams
If you believe that any content accessible via StreamrTV violates applicable law or infringes upon your rights, you may submit a takedown request at https://forms.gle/wJ8J6G3kZKNytGu77. Upon receiving a valid notice, we may:
Restrict visibility within the StreamrTV interface;
Block access via application-level discovery mechanisms;
Remove the content from the Streamr Network and the StreamrTV application.
12. Financial Services and Compliance
Regulatory Compliance: Super Balloons transactions are subject to financial services and e-commerce regulations. We may request additional information from users to comply with Know Your Customer (KYC), Know Your Business (KYB), anti-money laundering (AML), and other regulatory requirements.
Account Verification: Merchants must complete identity and business verification through our payment processor before selling Super Balloons. Failure to complete verification may result in service suspension.
Reporting Requirements: We may report transaction information to relevant authorities as required by law. Large or unusual transaction patterns may trigger additional compliance reviews.
Service Availability: Financial services availability depends on your location and our payment processor's supported regions. We reserve the right to restrict services in certain jurisdictions.
13. Third-Party Payment Services
Super Balloons Integration: Super Balloons are provided through integration with Stripe, Inc. Your use of these services is also governed by:
Stripe Services Agreement (https://stripe.com/legal/ssa)
Stripe Connected Account Agreement (https://stripe.com/legal/connect-account)
Stripe Privacy Policy (https://stripe.com/privacy)
Third-Party Terms: In case of conflict between these Terms and Stripe's terms regarding payment processing, Stripe's terms shall govern for payment-related matters.
Service Modifications: Our payment processing partner may modify their services, which may affect Super Balloons availability or functionality. We will provide reasonable notice of material changes when possible.
14. Updates to Payment Terms
We may update payment-related terms more frequently than other sections due to regulatory requirements or changes by our payment processing partners. Material changes to Super Balloons terms will be communicated through the Service interface and/or email notification at least 30 days before taking effect, where legally required.
15. Governing Law and Jurisdiction
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
Jurisdiction: Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zug, Switzerland, except where:
Mandatory consumer protection laws in your jurisdiction require disputes to be resolved locally
EU residents have the right to bring disputes in the courts of their country of residence under EU consumer protection regulations
Specific payment disputes governed by Stripe's arbitration provisions (as referenced in Section 13)
Cross-Border Considerations: If you access the Service from outside Switzerland, you are responsible for compliance with local laws in your jurisdiction. By using the Service, you consent to the transfer of your information to Switzerland and processing under Swiss law.
